WND provides both factual and opinion evidence, from a land use planning perspective, for all types of expropriation matters. WND has fulfilled many roles in the expropriation process, including determining the most appropriate land use at the time of expropriation, determining the effects of the expropriation on lands after expropriation, as well as providing evidence in support of compensatory matters.
WND often utilizes its own private library (and full-time librarian) as a valuable source of historical research information. Our library contains a wide range of material including many historical documents which are no longer available in print and which provide useful and necessary background material in expropriation proceedings.
Representative assignments completed by WND include:
WND represented several landowners in the City of Burlington, Ontario who were expropriated by the Ontario Management Board Secretariat or the Ontario Realty Corporation to facilitate the construction of Highway 407. On behalf of these landowners, WND provided both factual and opinion evidence relating to what the expected, most appropriate land use would have been at the time of expropriation, in the absence of reasons or schemes for which the expropriation(s) took place. In some instances WND was also requested to provide similar evidence on the effect of the expropriation on the remaining lands owned by the respective landowners, after the taking was completed. This analysis was provided in order to assist in the determination of the appropriate level of compensation for the taking, as well as to assist in the analysis of Injurious Affection claim(s).
On behalf of the Ontario Ministry of Transportation, WND prepared a report to provide factual and opinion land use planning evidence regarding the potential use of lands expropriated from Bonus Bucks Inc. for the purposes of a gas bar with an associated retail kiosk in the City of Burlington. The report commented on the likelihood of municipal approvals for additional uses forming part of a proposal to be put forward by Bonus Bucks Inc., including a drive-through restaurant-type use.
On behalf of the Ontario Ministry of Transportation, WND prepared reports reviewing the land use planning history of land parcels expropriated to facilitate the future expansion of Highway 401 and the construction of the Highway 401 interchange at Mavis Road in the City of Mississauga. The report also provided a review of land use constraints for the expropriated parcels and the surrounding area.
